Permanent arbitration court based in Prague.

We resolve disputes arising from domestic and international commodity trading and related receivables. We save parties both time and resources.

The International Arbitration Court in Prague at the Czech-Moravian Commodity Exchange Kladno is a permanent arbitration court established under Act No. 229/1992 Coll. on Commodities Exchanges in accordance with Act No. 216/1994 Coll. on Arbitration Proceedings and on the Enforcement of Arbitral Awards. The Statute and Rules of Procedure have been published in the Commercial Bulletin.

Arbitration at PRIAC ensures the highest standard thanks to precise rules and rigorous requirements placed on arbitrators on the List. An arbitral award is a fully enforceable title in the Czech Republic; in international disputes, it is enforceable in over 170 states under the 1958 New York Convention.

Flexibility

Parties set procedural rules according to the nature of the dispute.

Arbitration adapts. Parties may agree that the dispute will be decided solely on the basis of written submissions, that the arbitral award will be issued without reasoning, or that the dispute will be decided according to principles of equity. None of this is possible in ordinary courts.

Confidentiality

Hearings and awards are, as a rule, non-public.

Unlike ordinary court proceedings, arbitration proceedings and arbitral awards are, as a rule, confidential. Confidentiality protects the commercial relationships of the parties and sensitive business information that could otherwise be harmed by disclosure in court.

Pillar 03

Expertise

The dispute is heard by an expert in the subject matter.

PRIAC arbitrators are experienced experts who deal with the relevant subject matter in their professional practice. This ensures high-quality decisions and often a better understanding of the specifics of the dispute than ordinary courts can offer.

Pillar 04

Impartiality

Inclusion on the List of Arbitrators is subject to approval by the Presidium.

Every candidate for inclusion must complete training and an interview. Inclusion is approved by the Presidium of the Court following individual assessment. Parties freely choose their arbitrator, but always from the vetted pool on the List.

Four steps to a binding award

From the parties' agreement on arbitration to an enforceable arbitral award.

Arbitration clause

A validly concluded arbitration agreement or clause transfers jurisdiction to decide the dispute to PRIAC. The clause may be inserted into a new contract or added by amendment to existing contracts. Written form is always required — electronic conclusion is sufficient if the contracting parties can be identified.

Filing the statement of claim

The statement of claim is filed with the Arbitration Court in a manner similar to ordinary courts. Requirements are set out in §§ 18 and 19 of the Rules. Hearing of the case is conditional on payment of the registration fee for arbitration and the lump sum for administrative costs — calculated according to the Rules on Costs.

Arbitration proceedings

The dispute is decided by one or three arbitrators — experts on the relevant commercial subject matter who devote themselves fully to the case. Parties may agree to proceedings based solely on written submissions without an oral hearing, or to an award without written reasoning (§ 28 of the Rules).

Binding award

The award is final, binding, and constitutes an enforcement title. In the Czech Republic, the prevailing party may enforce it directly through the courts; internationally, enforceability is guaranteed by the New York Convention in over 170 contracting states.

PRIAC arbitrators come from the Czech Republic, Austria, Slovakia, Turkey, Kazakhstan and other jurisdictions. They decide disputes in Czech, English, French, German, Polish and Russian.
